Terms of Service

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off Period: The period during which the consumer can exercise their right of withdrawal.
  • Consumer: A natural person not acting in the exercise of a profession or business who enters into a distance agreement with the entrepreneur.
  • Day: Calendar day.
  • Digital Products: Non-physical products, such as downloads, delivered exclusively in digital format.
  • Physical Products: Tangible items that are shipped to the consumer after purchase.
  • Entrepreneur: Izzi Baby, offering products and/or services remotely to consumers.
  • Distance Agreement: An agreement concluded within the framework of a system for the distance sale of products and/or services, organized by the entrepreneur, exclusively using distance communication.

Article 3 – Applicability

These terms and conditions apply to every offer by Izzi Baby and every distance agreement concluded between Izzi Baby and the consumer. The text of these terms is provided to the consumer before or during the conclusion of the agreement.

Article 4 – The Offer

  1. If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.
  2. The offer includes a complete and accurate description of the products and/or services offered. Images are a true representation but may differ slightly in colors and details.
  3. For digital products, it is explicitly stated that they are non-returnable after delivery.
  4. For physical products, information about delivery times, return policies, and any exceptions (such as hygiene products or personalized items) is clearly stated.

Article 5 – The Agreement

  1. The agreement is concluded at the moment of acceptance by the consumer and compliance with the specified conditions.
  2. After the agreement is concluded, the consumer will receive confirmation via email.
  3. Izzi Baby reserves the right to cancel an order in cases of misuse, technical errors, or force majeure.

Article 6 – Right of Withdrawal

Digital Products:

  • The right of withdrawal does not apply to digital products once delivery has started with the consumer's consent.
  • Purchases are final once the download link is provided.

Physical Products:

  • Consumers have the right to return physical products within 30 days after receiving them.
  • The product must be unused, in its original condition, and in its original packaging.
  • Hygiene products and personalized items cannot be returned for safety and customization reasons.

Article 7 – Refunds

  1. Digital Products: Refunds are only issued in cases of technical errors or faults with the file. Consumers must contact Izzi Baby for assistance.
  2. Physical Products: Refunds are processed once the returned item is received and inspected. Refunds may take up to 10 business days to be processed.
  3. Shipping costs for returns are the responsibility of the consumer unless the return is due to an error by Izzi Baby.

Article 8 – Intellectual Property

  1. All digital products, text, images, social media content, and any other materials from Izzi Baby are protected by copyright and intellectual property rights.
  2. It is prohibited to copy, share, or reproduce these materials without prior written consent from Izzi Baby.
  3. Izzi Baby reserves the right to claim damages proportional to the harm caused by the violation.

Article 9 – Delivery

Digital Products:

  • Digital products are delivered immediately after payment via email or download link.
  • Consumers are responsible for providing an accurate email address to ensure smooth delivery.

Physical Products:

  • Physical products are shipped within 7-10 business days after the order is placed.
  • If an order is delayed beyond this timeframe, consumers will be notified via email.

Article 10 – Payment

  1. Payments must be made using the payment methods provided on the website.
  2. Digital products are delivered only after payment has been received.
  3. Physical products are processed and shipped only after payment has been confirmed.

Article 11 – Liability

  1. Izzi Baby is not liable for damages resulting from improper use of digital or physical products.
  2. The liability of Izzi Baby is limited to the purchase price of the product.
  3. Izzi Baby is not responsible for shipping delays caused by third-party carriers.

Article 12 – Complaints

  1. Complaints must be submitted within 7 days of discovery.
  2. Izzi Baby will respond to complaints within 14 days. If valid, a suitable solution will be provided.

Article 13 – Governing Law

All agreements between Izzi Baby and the consumer are governed exclusively by Dutch law.

Article 14 – Amendments

Izzi Baby reserves the right to amend these terms and conditions. Changes will be published on the website.
